This Privacy Policy explains how Elara ("Elara," "we," "us," or "our") collects, uses, and protects your information when you use our mobile application, website, and related services (collectively, the "Service").

We recognize that conversations with Elara may be personal, intimate, or emotionally meaningful. This policy is written to clearly explain how your data is handled and what boundaries exist.

By using the Service, you agree to the practices described in this Privacy Policy.

1. Information We Collect

a. Information You Provide

When you use Elara, you may provide:

  • Account information (such as an email address or authentication credentials)
  • Messages, conversations, and other content you submit through the Service
  • Communications with us, including support requests or feedback

b. Automatically Collected Information (Mobile App)

When you use the Elara iOS or Android app, we may automatically collect:

  • Device and application information (device type, operating system, app version)
  • Usage information (feature usage, interaction timestamps)
  • Log and diagnostic data (crash reports, error logs, performance metrics)

We do not use mobile advertising identifiers or track you across third-party apps or websites.

c. Website Information

When you visit our marketing website (talktoelara.com), we collect:

  • Analytics data through Google Analytics, including pages visited, time on site, and general geographic region
  • Standard server log data (IP address, browser type, referral source)

d. Optional Features

If you enable optional features (such as voice or image sharing), we collect and process the associated data solely to provide those features.

We do not sell personal information and do not use personal data for targeted advertising.

3. AI, Conversations, and Human Review

How Conversations Are Processed

Elara uses artificial intelligence to generate responses. Your messages are processed to generate replies and to support memory and personalization within your account.

Model Improvement

We may analyze conversations in aggregated or de-identified form to improve system behavior, safety, and reliability. We do not use your private conversations to intentionally recreate or share your personal messages with other users.

We may also use conversation data to develop, train, and improve our own AI models. Where possible, we apply de-identification or aggregation techniques prior to use for this purpose.

Human Review

We recognize that conversations with Elara can be personal in nature.

In limited circumstances, authorized members of the Elara team may review conversations to improve the quality, safety, and reliability of the Service, particularly during early development. Access is restricted, purpose-limited, and subject to internal safeguards.

We do not access conversations for entertainment, marketing, or advertising purposes.

Memory Limitations

Memory and conversational continuity features are selective and imperfect. Elara may forget, misremember, or provide incorrect or inconsistent information about prior conversations, preferences, or its own characteristics. We do not guarantee complete or accurate recall.

4. Data Sharing and Third-Party Processing

We do not sell your personal information.

We may share information with:

  • Service providers and subprocessors, including AI infrastructure providers, hosting providers, analytics services, and security vendors, who process data on our behalf solely to operate the Service
  • Legal or regulatory authorities, when required by law or to protect safety, rights, or legal obligations
  • Business successors, in the event of a merger, acquisition, or asset sale, with notice provided where required by applicable law

Our AI infrastructure providers process inputs solely to generate responses and are contractually restricted from using your data to train or improve their own models.

All service providers are required to protect your information and use it only for authorized purposes.

5. Data Retention

We retain your personal information for the following periods:

  • Account information: Retained for the duration of your account, plus up to 90 days following deletion to allow for account recovery if requested
  • Conversation data: Retained for the duration of your account. Upon account deletion, conversation data is deleted within 30 days, except where retention is required by law
  • Aggregate or de-identified data: May be retained indefinitely, as it cannot reasonably be used to identify you
  • Legal and compliance records: Retained for up to 7 years where required by applicable law

6. Cookies and Tracking Technologies

Mobile App

The Elara iOS and Android apps do not use cookies. We do not use Apple's Advertising Identifier (IDFA) or Google's Advertising ID (GAID) for advertising purposes.

Marketing Website

Our marketing website uses the following types of cookies:

  • Strictly necessary cookies: Required for the website to function correctly. These cannot be disabled.
  • Analytics cookies (Google Analytics): Help us understand how visitors use our website so we can improve it. These are only set with your consent.

We do not use cookies for advertising or to track you across third-party websites.

Managing your preferences: When you first visit our website, we will ask for your consent before setting any non-essential cookies. You can update your preferences at any time through the cookie settings link in the footer, or by adjusting your browser settings.

For visitors in the EU and UK, non-essential cookies will not be set until you provide affirmative consent.

7. Security

We implement reasonable administrative, technical, and organizational safeguards designed to protect your information from unauthorized access, disclosure, or loss.

However, no system is completely secure, and we cannot guarantee absolute security. In the event of a data breach that affects your rights or interests, we will notify you as required by applicable law.

8. Children's Privacy

Elara is not intended for use by individuals under the age of 18.

We do not knowingly collect personal information from children. If we become aware that personal information from a minor has been collected, we will take steps to delete it promptly.

European and UK Users (GDPR / UK GDPR)

If you are located in the European Economic Area (EEA) or United Kingdom, you have rights under the General Data Protection Regulation (GDPR) and UK GDPR.

Our lawful bases for processing your data are:

  • Contract: Processing necessary to provide the Service you signed up for, including generating AI responses and maintaining your account
  • Legitimate interests: Improving the safety, quality, and reliability of the Service, where not overridden by your interests or fundamental rights
  • Consent: Where we have asked for and received your explicit consent, including for analytics cookies on our website and any optional features

You may withdraw consent at any time without affecting the lawfulness of processing prior to withdrawal.

10. International Data Transfers

Elara is based in the United States. If you access the Service from the EEA, UK, or other regions with data protection laws, your information may be transferred to and processed in the United States or other countries where our service providers operate.

For transfers of personal data from the EEA or UK to the United States, we rely on Standard Contractual Clauses (SCCs) as approved by the European Commission, and their UK equivalent (International Data Transfer Agreements) where applicable. We require our service providers to maintain equivalent protections.
