Welcome to Elara ("Elara," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the Elara mobile application, website, and related services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Elara Is (and Is Not)

Elara is an AI-powered conversational service designed to provide engaging, supportive, and personalized conversations.

  • Is not a human
  • Does not have consciousness, emotions, or personal awareness
  • Does not provide medical, psychological, legal, or financial advice

Elara is not a therapist, counselor, or healthcare provider, and interactions with Elara are not a substitute for professional care or real-world relationships.

If you are experiencing distress, crisis, or thoughts of self-harm, please seek immediate assistance from qualified professionals or local emergency services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

Elara is not intended for use by children, and we do not knowingly collect personal information from individuals under 18. By using the Service, you represent and warrant that you meet this requirement.

3. Your Account

To access certain features, you may be required to create an account.

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activity that occurs under your account

You are responsible for any unauthorized access resulting from your failure to safeguard your account.

4. AI-Generated Content

Responses generated by Elara are produced by artificial intelligence.

You acknowledge and agree that:

  • Responses may be inaccurate, incomplete, or incorrect
  • Elara may misunderstand context, intent, or emotional nuance
  • Memory and conversational continuity features are imperfect and not guaranteed

You should not rely on Elara for decisions involving health, safety, legal matters, or significant life choices.

5. Acceptable Use

You agree not to use the Service to:

  • Engage in illegal, harmful, or abusive activity
  • Harass, threaten, or exploit others or the Service
  • Attempt to reverse-engineer, manipulate, or bypass safeguards
  • Generate content that violates applicable laws or third-party rights

We may investigate and take action for violations of these Terms.

6. Emotional Use and Boundaries

Elara is designed to offer engaging and supportive conversations. However, Elara is not intended to replace meaningful human relationships or professional support.

We encourage users to maintain a healthy balance between digital interactions and real-world connections. Elara cannot provide crisis support or emotional care services.

7. Subscriptions and Payments

Certain features may require a paid subscription.

If you purchase a subscription:

  • Fees are billed in advance
  • Purchases are non-refundable except as required by applicable law or platform policies
  • Refund requests for purchases made through the App Store or Google Play must be

    • submitted through the applicable platform and are subject to that platform's refund rules

  • Subscription pricing and terms may change with notice

8. Content Ownership and Rights

Your Content

You retain ownership of any text, messages, images, or other content you submit through the Service ("User Content").

By using Elara, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, process, and use your User Content solely to:

  • Operate and maintain the Service
  • Provide conversational continuity and memory features
  • Improve system performance, safety, and quality

This license ends when your User Content is deleted, except where retention is required by law or for legitimate operational purposes.

AI-Generated Responses

We retain all rights to the Service, including the software, models, prompts, and systems used to generate responses.

We do not claim ownership over individual AI-generated responses. Responses are provided for your personal use, and you may view, copy, and share them. Because content is generated by artificial intelligence, similar or identical responses may be generated for other users.

9. Intellectual Property

All intellectual property associated with the Service, excluding User Content, is owned by Elara or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if:

  • You violate these Terms
  • We discontinue the Service
  • We believe continued access poses risk to users, the Service, or others

You may stop using the Service at any time.

11. Disclaimers

The Service is provided "as is" and "as available."

To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law, Elara and its affiliates will not be liable for any indirect, incidental, special, consequential, or emotional distress damages.

Our total liability will not exceed the amount you paid us (if any) in the twelve (12) months preceding the claim.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide notice through the Service. Continued use after changes constitutes acceptance of the updated Terms.

14. Governing Law
